In a recent opinion,
Ofcom,
the regulator for the UK telecommunications industries,
has
upheld a claim brought by a Libyan tour guide
unknowingly filmed as part of a BBC documentary. Though
there exist certain significant differences in terms of
the impact of the surrepitious behavior, the privacy
principle addressed by Ofcom is similar to that alleged
in a complaint filed on behalf of a woman unknowingly
filmed in Chicago as part of a documentary produced in

misrepresentation, breach of privacy, and defamation
arising from the publication of nude photographs of Jane
Doe, a figure model, by Columbia College Chicago taken
without Ms. Doe's authorization by student photographer
Brian Morowczynski.

Charles Lee Mudd Jr. successfully settles litigation
brought on behalf of a Jane Doe for breach of privacy
arising from the unauthorized distribution of
photographs accompanied by defamatory statements. On a
Friday in the summer of 2003, Jane Doe received
communications from her friends and those with whom she
worked that emails containing defamatory statements and
photographs of Jane Doe had been received from an
anonymous source. The very next Monday, Charles Lee Mudd
Jr. filed a Complaint against the suspected defendant,
obtained leave to initiate discovery, and obtained a
temporary restraining order. Within a short amount of
time, Charles had obtained documentation sufficient to
trace the anonymous emails to a particular telephone
number (that of the defendant's home) and the
defendant's employer. Settlement discussions began in
earnest upon receipt by the defendant's counsel of the
subpoenaed information. Fortunately, all third parties
involved were understanding of the situation and
cooperated as best they could.

Amicus Curiae brief before the United States Court
of Appeals for the Federal District in support of the appellee,
Skylink Technologies, Inc., in appeal (04-1118) from the United
States District Court, Northern District of Illinois, Chamberlain
Group, Inc. v. Skylink Technologies, Inc., 02-cv-6376. Charles
Lee Mudd Jr. served as local counsel in the Northern District
of Illinois.

Charles Lee Mudd Jr. successfully settles litigation brought
against Brian Smith on behalf of his client F/X
Communications of Denmark, a software developer. This
matter involved online defamation, false light, tortious interference
with business and prospective business relations, and breach
of contract. Three months after filing the Complaint against
Brian Smith, Charles Lee Mudd Jr. obtained a satisfactory settlement
for F/X Communications.
